1. About these terms

These Terms of Use (“Terms”) govern your access to and use of surfersfresh.com (the “Site”), operated by Surfers Fresh (“Surfers Fresh”, “we”, “us”), an independent music label based on the Gold Coast, Queensland, Australia. By visiting the Site you agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. The Site

The Site is a promotional showcase for the Surfers Fresh roster. It does not provide accounts, downloads, e-commerce, or payment services. Music streams, downloads, and merchandise (if any) are provided through third-party platforms (such as YouTube, Spotify, and Apple Music) and are subject to the terms of those platforms.

3. Intellectual property

The artwork, designs, copy, audio recordings, and other creative material on the Site (the “Materials”) are owned by Surfers Fresh or our licensors and are protected by copyright, trade-mark, and other intellectual-property laws. The “Surfers Fresh” name and logo are trade marks of Surfers Fresh.

You may view, share links to, and embed publicly published videos for personal, non-commercial purposes via the official embed mechanisms provided by YouTube and other platforms. You must not reproduce, modify, distribute, publicly perform, or create derivative works from the Materials without our prior written permission, except as permitted by applicable law (including fair-dealing provisions of the Copyright Act 1968 (Cth)).

Third-party stock-media used in our visual assets is licensed from providers including Pexels and Pixabay. Attributions are maintained at /static/img/icons/attributions.txt.

4. YouTube embeds and third-party platforms

The Site embeds and links to content hosted on YouTube. By interacting with embedded YouTube content, you also agree to:

5. Acceptable use

You agree that you will not:

  • use the Site in any way that breaches applicable law;
  • attempt to interfere with the Site’s operation, security, or availability;
  • scrape, mirror, or systematically copy the Site without our written permission;
  • use the Materials in any way that suggests an endorsement, sponsorship, or partnership that has not been agreed in writing;
  • use the Materials to train machine-learning, generative-AI, or large-language models without our prior written consent.

6. Disclaimer

The Site is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we exclude all representations and warranties, whether express or implied, relating to the Site and the Materials, including warranties of accuracy, completeness, fitness for purpose, and non-infringement. Nothing in these Terms excludes any guarantees under the Australian Consumer Law that cannot lawfully be excluded.

7. Limitation of liability

To the maximum extent permitted by law, Surfers Fresh, its directors, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenue, arising out of or in connection with your use of the Site, even if we have been advised of the possibility of such damages. Where our liability cannot be excluded but can be limited, our total liability is limited to AUD 100.

8. Indemnity

You agree to indemnify and hold Surfers Fresh harmless against any claim, loss, damage, or expense arising from your breach of these Terms, your misuse of the Site, or your infringement of any third-party right.

9. Changes to the Site and these Terms

We may modify, suspend, or discontinue the Site or any part of it at any time without notice. We may also revise these Terms. Revised Terms take effect when posted to the Site, and your continued use after that date constitutes acceptance.

10. Governing law

These Terms are governed by the laws of Queensland, Australia. You and we submit to the exclusive jurisdiction of the courts of Queensland and the federal courts of Australia in relation to any dispute arising under or in connection with these Terms.
